TERMS AND CONDITIONS - TESLA GIVEAWAY

The duration of the giveaway is from November 5th, 2023, 6:00 PM (CET) until November 12th, 2023, 6:00 PM (CET). Within this period, users will be given the opportunity to participate in the giveaway online.

To participate in the giveaway, the following is required:

• Follow the @gotbag Instagram account.
• Like the Instagram post by @gotbag dated November 5, 2023.
• Tag one friend in the comments.
• Share the post on your Instagram Story and tag @gotbag.

An infinite number of entries per participant can be made by commenting and tagging a friend under the post, increasing their chances of winning. Entry is only possible within the entry period. Entries received after the closing date will not be considered for the draw.

Participation in the competition is free of charge.

Eligible participants are natural persons over 18 years of age (and individuals over 14 years of age, provided their legal representative gives written consent for their participation). Participation is not limited to customers of the organizer and does not require the purchase of any goods.

Only entries made from public Instagram accounts can be considered. Unfortunately, private accounts cannot be taken into account.

Should a participant be restricted in his legal capacity, the consent of his legal representative is required.

Not eligible to participate in the competition are all persons involved in the conception and implementation of the competition and employees of the operator as well as their family members. In addition, the operator reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons, for example:

• in the event of manipulation in connection with access to or implementation of the giveaway,
• in the event of violations of these conditions of participation
• in the event of unfair practices or
• in the event of false or misleading information in connection with participation in the giveaway.

1. Winnings

The prize consists of the following:

• Tesla Model 3
• Features: Roof tent incl. accessories and thermal inlay
• folding table including two chairs
• Scotti grill
• GOT BAG Starter Kit worth €535 (RE:SHELL Cabin black, ROLLTOP black, MOON BG small black, SHOWER BAG black, BOTTLE)

Each finalist will receive a GOT BAG Starter Kit worth €535 (RE:SHELL Cabin black, ROLLTOP black, MOON BAG small black, SHOWER BAG black, BOTTLE).

2. Drawing and notification

Within the giveaway period, the operator will draw one finalist each day from Monday to Saturday at 6:00 pm (CET). The finalists will be selected randomly among all participants. They will be informed via direct message and comments. Additionally, the operator reserves the right to mark them in the daily draw story on Instagram.

The winner of the main prize will be drawn from the six finalists. This draw will take place randomly on November 12, 2023. The result will be announced at 6:00 pm (CET) on the @gotbag Instagram account, and the winner will be informed.

3. Transmission of the prize

Each finalist will receive a GOT BAG Starter Kit. The operator will cover any shipping costs associated with sending the GOT BAG Starter Kit. 

However, the winner must personally collect the Tesla on-site (Mainz, Germany). Any additional costs associated with claiming the prize will be the responsibility of the winner. The winner is also responsible for any potential taxation related to the prize.

If the winner fails to respond within a period of 3 weeks after two requests, the prize may be transferred to another participant.

The winner, by participating, agrees to the filming of the prize presentation. The video of the prize presentation may be published on Instagram.

The winner must make a decision to accept or decline the prize within 30 days after the draw. A contract will be drafted between the winner and the organizer, which will be signed by both parties upon acceptance of the prize. If the winner chooses to decline the prize, it will be transferred to another participant.

The organizer expressly reserves the right to terminate the giveaway without prior notice and without giving reasons. This applies in particular to any reasons that would disrupt or prevent the competition from running as planned.

The organizer points out that all personal data of the participant will neither be passed on to third parties nor given to them for use without consent.

In the event of a win, the winner agrees to the publication of his/her name and place of residence in the advertising media used by the organizer. This includes the announcement of the winner on the website of the operator and its social media platforms.

The participant may revoke his/her declared consent at any time. The revocation must be sent in writing to the contact details of the organizer stated in the imprint of the website of GOT BAG GmbH. After revocation of the consent, the collected and stored personal data of the participant will be deleted immediately.

GOT BAG GmbH is released from all obligations upon delivery of the prize. The same applies if GOT BAG is not or no longer able to provide the prize due to entrepreneurial circumstances.

The giveaway of the operator is exclusively subject to the law of the Federal Republic of Germany. The legal process is excluded.

Should any provision of these terms and conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these terms and conditions of participation. In place of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same applies in the event of a loophole in these conditions of participation.
